OVERVIEW
This website is operated by A&J Racing International, the authorized Canadian distributor of Spoon Sports products. Throughout this site, the terms "we," "us," and "our" refer to A&J Racing International operating as Spoon Sports Canada. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms of Service, including those additional terms and conditions referenced herein. These Terms apply to all users of the site, including browsers, customers, and contributors of content.
Please read these Terms carefully before accessing or using our website. If you do not agree to all terms and conditions, you may not access the website or use any services.
Our store is hosted on Shopify Inc., which provides us with the e-commerce platform that allows us to sell our products and services to you.

SECTION 1 — ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province or territory of residence. You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction in connection with your use of our Service. You must not transmit any worms, viruses, or code of a destructive nature. A breach or violation of any of these Terms will result in immediate termination of your access to our Services.

SECTION 2 — GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us. Credit card information is always encrypted during transfer over networks. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 — PRODUCTS AND PERFORMANCE PARTS
All products sold through Spoon Sports Canada are genuine Spoon Sports products imported and distributed under authorized agreement with Spoon Sports Co., Ltd. (Japan).
Fitment and Compatibility: Product descriptions, specifications, and compatibility information are provided in good faith and to the best of our knowledge. It is the customer's sole responsibility to verify fitment and compatibility with their specific vehicle before purchasing. We strongly recommend consulting a qualified mechanic or installer prior to purchase. We are not liable for any costs arising from incorrect part selection.
Performance Parts Advisory: Performance parts may alter the handling, braking, acceleration, and safety characteristics of your vehicle. Installation of performance parts may affect your vehicle's compliance with local road regulations, provincial emissions standards, and insurance coverage. It is your responsibility to ensure any modifications comply with applicable laws in your province or territory. Spoon Sports Canada accepts no liability for any consequences arising from the improper selection, installation, or use of any product purchased through our store.
Track and Racing Use: Many Spoon Sports products are designed for motorsport and track use. Products used in racing or competitive driving are done so entirely at the user's own risk. No warranty or liability applies to products used in racing, track days, or any competitive motorsport application.
Product Display: We have made every effort to display product images and colors as accurately as possible. We cannot guarantee that your monitor's display of any color will be perfectly accurate.
We reserve the right to limit quantities, discontinue products, or restrict sales to any person or region at our sole discretion.

SECTION 4 — ACCURACY OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete, or current. Material on this site is provided for general information only. We reserve the right to modify site contents at any time without obligation to update any information. Occasionally there may be typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, or availability. We reserve the right to correct any errors and cancel orders where inaccurate information was present, including after an order has been submitted.

SECTION 5 — PRICING AND PAYMENT
All prices are listed in Canadian Dollars (CAD) and are subject to applicable federal and provincial taxes. Prices are subject to change without notice. We reserve the right to cancel any order where a pricing error has occurred, in which case a full refund will be issued promptly. We do not store your full payment card details on our servers.

SECTION 6 — ORDERS, BILLING, AND ACCOUNT INFORMATION
We reserve the right to refuse any order at our sole discretion. We may limit or cancel quantities purchased per person, per household, or per order, including orders placed under the same customer account, credit card, or shipping address. We reserve the right to limit or prohibit orders that appear to be placed by resellers or distributors outside of our authorized network.
In the event that we modify or cancel an order, we will attempt to notify you using the contact information provided at the time of purchase.
You agree to provide current, complete, and accurate purchase and account information for all purchases and to promptly update your account information as needed so we can complete your transactions and contact you.

SECTION 7 — CANCELLATIONS
Cancellation requests must be submitted within 24 hours of order placement by contacting us directly. We cannot guarantee cancellation after this window as orders may have already been processed or shipped. Orders that have been dispatched cannot be cancelled and must follow our Returns process.

SECTION 8 — SHIPPING
We ship within Canada only unless otherwise stated at checkout. Shipping times are estimates and are not guaranteed. Spoon Sports Canada is not responsible for delays caused by carriers, weather, or circumstances beyond our control. Risk of loss and title passes to you upon delivery to the carrier. Tracking information will be provided upon dispatch. If a shipment is lost or damaged in transit, contact us within 7 days of the expected delivery date.

SECTION 9 — RETURNS AND EXCHANGES
Due to the specialized nature of performance automotive parts, all sales are considered final unless the product arrives damaged, defective, or is significantly not as described.
Eligible returns must meet all of the following conditions:

Return request submitted within 14 days of delivery
Product is unused, uninstalled, and in its original packaging with all included hardware and documentation
Original proof of purchase is provided
Prior written return authorization has been issued by us

Non-returnable items include:

Electrical components including ECUs, sensors, and wiring harnesses
Gaskets and seals once packaging has been opened
Special order or custom items
Any product that has been installed, modified, or shows signs of use
Items used in racing or track applications

Approved returns will be refunded to the original payment method, minus any applicable restocking fee. Shipping costs are non-refundable. Return shipping is the customer's responsibility unless the return is due to our error. To initiate a return, contact us at the address listed in Section 20 with your order number and reason for return. Do not ship anything back without prior written authorization.

SECTION 10 — WARRANTY
Spoon Sports products are subject to the manufacturer's warranty terms as established by Spoon Sports Co., Ltd. (Japan). Spoon Sports Canada does not offer additional warranties beyond what the manufacturer provides. Warranty claims must be submitted to us in writing and may require the product to be returned for inspection at the customer's expense.
Warranty coverage does not apply to damage resulting from improper installation, misuse, neglect, accident, racing or track use, unauthorized modification, or normal wear and tear. We do not warrant that the quality of any products will meet your expectations or that errors in product descriptions will always be corrected.

SECTION 11 — THIRD-PARTY LINKS AND TOOLS
Certain content or links on our site may direct you to third-party websites not affiliated with us. We are not responsible for the content, accuracy, or practices of any third-party sites and will not be liable for any harm or damages related to third-party products, services, or transactions. We may also provide access to optional third-party tools on an "as is" basis without any warranties of any kind. Use of such tools is entirely at your own risk.

SECTION 12 — INTELLECTUAL PROPERTY
All content on this website including text, images, logos, graphics, and product photography is the property of A&J Racing International, Spoon Sports Canada, or Spoon Sports Co., Ltd. and is protected under applicable Canadian and international intellectual property laws. You may not reproduce, distribute, or use any content from this site without prior written permission.

SECTION 13 — USER SUBMISSIONS
Any comments, feedback, or submissions you send to us may be used by us without restriction or compensation. You are solely responsible for the accuracy and content of anything you submit. We reserve the right to monitor, edit, or remove any content we determine to be unlawful, offensive, or otherwise objectionable at our sole discretion.

Your submission of personal information through this store is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We reserve the right to terminate your use of the Service for violating any prohibited use.

We do not guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free. The Service and all products are provided "as is" and "as available" without any warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, or non-infringement.
To the maximum extent permitted by applicable Canadian law, A&J Racing International, its directors, officers, employees, affiliates, agents, contractors, suppliers, and licensors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind — including lost profits, lost revenue, loss of data, or replacement costs — arising from your use of our Service or any products purchased through it, even if advised of the possibility of such damages. Where provincial law does not permit the exclusion of certain warranties or limitations of liability, our liability shall be limited to the maximum extent permitted by law.

SECTION 17 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless A&J Racing International and its parent companies, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers, and employees from any claim or demand, including reasonable legal fees, made by any third party arising from your breach of these Terms of Service or your violation of any law or the rights of a third party.

SECTION 18 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law and the unenforceable portion shall be deemed severed. This shall not affect the validity of any other remaining provisions.

SECTION 19 — TERMINATION
These Terms are effective unless and until terminated by either party. We may terminate this agreement at any time without notice if you fail to comply with any term herein. All obligations and liabilities incurred prior to termination shall survive termination for all purposes.

SECTION 20 — GOVERNING LAW
These Terms of Service are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.

SECTION 21 — ENTIRE AGREEMENT AND WAIVER
These Terms of Service and any policies posted by us on this site constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

We reserve the right to update, change, or replace any part of these Terms at any time by posting updates to this page. It is your responsibility to check this page periodically. Your continued use of the website following any changes constitutes acceptance of those changes.
